शालिकरामको आत्महत्या र रविको पक्राउले उठाएका कानुनी प्रश्‍नहरू

पत्रकार शालिकराम पुडासैनीले चितवनको एक होटलमा गरेको भनिएको आत्महत्यामा आत्महत्याअघिको ‘सुसाइड नोट’मा नाम किटेकै वा पोलेकै आधारमा प्रहरीले चर्चित टेलिभिजन प्रस्तोता रवि लामिछानेसहित तीन जनालाई पक्राउ गरी भइरहेको एउटा अनुसन्धानले यतिबेला राष्ट्रिय/अन्तर्राष्ट्रिय रुपमा चर्चा लिइरहेको छ। रवि लामिछानेको विषयमा अदालतमा मुद्दा दर्ता भइसकेको छ।

यो घटनापछि मानिसले मृत्युभन्दा पहिले गरेको घोषणा वा आरोपका आधारमा मात्र कसैलाई कारबाही गर्न मिल्छ कि मिल्दैन भनेर बहस हुन थालेको छ।

कतिपयले मर्ने व्यक्तिले सामान्यतया: झुटो बोल्दैनन् भन्‍ने आधारमा त्यसलाई पूर्ण प्रमाण मानिने बताएका छन् भने कतिपयले त्यस्तो नहुने बताएका छन्।

मृत्युअघि लगाइएको आरोप मुद्दाको दरिलो प्रमाण हुन नसक्ने छिमेकी भारत लगायतका देशहरूमा पहिलेदेखि कार्यान्वयनमा रहेको यस्तो व्यवस्था नेपालमा नयाँ भएकाले अन्योल रहेको छ।

मृत्युकालीन घोषणका मान्यताहरु

मृत्युकालीन घोषणालाई ‘Leterm Mortem’ भनिन्छ। यसको अर्थ हो, Words said before death.’

त्यस्तै चर्चित कवि म्याथ्यू आर्नोल्डले सन् १८८३ मा लेखेको कविता ‘सोहराब एन्ड रुस्तम’मा भनेका छन्- मर्न लागेको मानिसको ओठमा सत्य बसेको हुन्छ (Truth sits upon the lips of dying men or A person, who is about die, would not lie)

विश्‍वविख्यात कवि शेक्सपियरले आफ्नो पुस्तक ‘In Richard II’ मा निम्न कुरा भनेका छन्।

“Where words are scarce, they are seldom spent in vain,

They breathe the truth that breathe their words in pain”.

न्यायाधीश लशका अनुसार ‘कुनै व्यक्ति जो चाँडै नै आफ्नो सृष्टि रचनाकर्ता परमेश्वरका समक्ष जाँदैछ भने निजले आफ्नो बोलीमा असत्य कुरा लिएर जाँदैन। मृत्यु हुनै लागेको स्थितिमा साँचो बोल्न प्रेरित गर्दछ। त्यसैले मरणासन्‍न व्यक्तिले झुटो बोल्दैन सत्य बोल्छ।

अन्तर्राष्ट्रिय प्रचलन


पछिल्लो समय आत्महत्यासँग सम्बन्धित घटनामा मृत्युअघि लेखिएका वा बोलिएका कुरालाई पनि प्रमाण मानेर अनुसन्धान गर्ने क्रम बढ्दो छ।

आत्महत्या दुरुत्साहन कसुरको प्रावधान अन्तर्गत यस्ता विषयलाई प्रमाणका रुपमा अगाडि सार्न थालिएको छ। अमेरिकामा १८ औँ शताब्दीदेखि नै मृत्युकालीन घोषणालाई फौजदारी अपराधमा प्रयोग गर्न थालिएको हो, भारतको प्रमाण ऐनको दफा ३२ (१) मा यसको व्यवस्था गरिएको छ। मर्न लागेको व्यक्तिले जिम्मेवार निकायसँग बोलेको कुरा (मृत्युकालीन घोषणा)लाई प्रमाण मान्न‍े गरिएको छ , तीन वर्षअघि भारतमा यस्तै घटना भएको थियो।

सर्वोच्च अदालतले पदबाट हटाएको दुई सातापछि अरुणाञ्चलका मुख्यमन्त्री कालिखो पलले ६० पेज (सम्भवत: विश्वकै सबैभन्दा लामो सुसाइड नोट) सुसाइड नोट लेखेर आत्महत्या गरे।

सुसाइड नोटमा तत्कालिन राष्ट्रपतिसहित मन्त्री, न्यायाधीशसहित थुप्रैको नाम उल्लेख गरेका थिए। उनीहरु भष्ट्राचारमा लिप्त भएको आरोप त्यसमा लगाइएको थियो। अदालतले सुसाइड नोट मृतक पलले नै लेखेको हो भन्नेमै प्रश्न उठायो।

त्यस्तै भारतको राजस्थानमा एउटी महिलालाई जबर्जस्ती सति जान बाध्य बनाएको आरोपमा आत्महत्या दुरुत्साहन कसुरमा त्यहाँ मुद्दा चलेको छ। भारतको बम्बई उच्च अदालतले आत्महत्या नोटमा कसैको नाम उल्लेख गर्दैमा मतियार मानिँदैन भन्दै भनेको छ, (A mere suicide note naming a person does not constitute sufficient evidence of the offence of abetment) अझ अगाडि भन्छ, ‘ This is no mathematical equation, that a suicide note plus threat equals abetment…If harassment is proved, show the proof.” He further said: “A threat to kill is not abetment. …An advice to kill is also not abetment.’

पञ्‍जाबमा एकजना कम्पनीका कर्मचारीले आत्महत्या गर्नुको कारण केही वकिल र आफ्नो हाकिम भएकाे उल्लेख गरेका रहेछन्, सो सम्बन्धमा त्यहाँको उच्चअदालतले भनेको छ, ‘jump to a conclusion that it is enough to mulct the accused with criminal liability under Section 306 IPC”. Rather than jumping around, “one has to analyse and examine the contents of the suicide note to find out whether it contains any incriminating information in the nature of instigation, provocation, forcing the victim to committed suicide.‘ पछि जाहेरी नै खारेज गरिदियो। भारतको सर्वोच्च अदालतले भनेको छ, ‘It must be recorded carefully and duly proved which the courts make admissible as the dying declaration.’ मृत्युकालीन घोषणालाई सुनिजान्ने प्रमाणको विकल्पको रुपमा दुई प्रमुख कारणले लिइएको पाइन्छ , (क) मृतकबाट प्राप्त प्रमाण ।(ख) मृतकले झुटो बोल्दैन, ‘It is thought that one who believes himself about to die has lost all motive for falsehood and will tell truth “lest he be punished in the hereafter

भारतीय सर्वोच्च अदालतले विभिन्न मुद्दाहरुमा मृत्युकालिन घोषणालाई प्रमाणमा लिन निम्न आधारहरु हुनुपर्छ–क) मृतक स्वस्थ रहेको हुनुपर्ने (ख) स्वैच्छिक घोषणा हो हाईन अन्य प्रमाणले पुष्टि हुनुपर्ने (ग) मृत्युकालिन घोषणालाई अन्य तथ्य र परिस्थितिजन्य प्रमाणले पुष्टि हुनु नपर्ने स्वेच्छिक भनाई वा नोट हो वा होइन भनी स्वतन्त्र र वस्तुगत प्रमाणले पुष्टि हुनुपर्ने आदि कारण भएमा मात्र मृत्युकालीन घोषणालाई प्रमाणमा लिन सकिन्छ। तर शारिरिक तथा मानसिक रुपमा स्वस्थ हुनु पर्दछ।

मृत्युकालिन घोषणालाई प्रमाणमा लिँदा निश्चित संयमता र अन्य विश्वसनीय प्रमाणबाट पुष्टि हुनु पर्दछ। मृतकको घोषणा र मृत्युवरणको समय सीमाले पनि यसलाई प्रमाण लिने वा नलिने निर्धारण गर्दछ।

मृत्यु अवश्यमभावी छ र बाँच्ने सम्भावना छैन भने वस्तुगत आधारमा पुष्टि भएमा उसको भनाइलाई प्रमाणमा लिइएको पाइन्छ। उसको भनाइ प्रमाणको रुपमा लिन  भारतको सर्वोच्च अदालतले भनेको छ। मृत्युकालिन घोषणालाई प्रमाणका रुपमा लिन सर्तकता अपनाउनु पर्दछ । सत्य बोल्छ भन्ने सपथ खाएको हुँदैन।

नेपालको कानुनी व्यवस्था र नजिरहरु


१. कानुनी व्यवस्था

मुलुकी अपराध संहिताको दफा १८५ मा भनिएको छ, ‘कसैले कसैलाई आत्महत्या गर्न, दुरुत्साहन दिन वा त्यस्तो काम गर्नेसम्मको परिस्थिति खडा गर्न वा गराउन हुँदैन।’ आत्महत्या गर्न बाध्य पार्नेलाई पाँच वर्षसम्म कैद र ५० हजार रुपैयाँसम्म जरिवाना हुने व्यवस्था गरेको छ।

नेपालको प्रमाण ऐन २०३१ ले मृत्युकालीन घोषणलाई अंगिकार गरेको छ, दफा ११ मरेको व्यक्तिले होस छँदै व्यक्त गरेका कुरा – कुनै मरेको व्यक्तिले आफू मर्न लागेको अवस्थामा होस छँदै आफ्नो मृत्युको कारणका सम्बन्धमा व्यक्त गरेको कुरा प्रमाणमा लिन हुन हुन्छ।

आत्महत्या दुरुत्साहनलाई कारबाहीको व्यवस्था हुनुअघि पनि नेपालमा त्यस्तै प्रकृतिका उजुरीहरू पर्ने गरेको,तर कारबाही गर्न अन्य मुद्दाहरू लगाइने गरेको वा मुद्दा दर्ता नहुने गरेको छ।

केहीलाई ज्यान मार्ने उद्योगमा मुद्दा चलेको पाइन्छ। स्वेच्छाले प्रेमीप्रेमिकाले आत्महत्या गर्न खोज्दा बचेका प्रेमिप्रमिकाकाे हकमा ज्यान मुद्दाको सजाय घटाइएको नजिर पनि रहेको छ।

२.मृत्युकालिन घोषणाको नजिर-आत्महत्या दुरुत्साहनलाई कानुनी दायरामा ल्याइएको एक वर्षमात्र भएपनि मृत्युकालिन घोषणाबारे विगतमाा विभिन्‍न नजिरहरू स्थापित भइसकेको पाइन्छ।

वि.सं. २०६७ जेठ ६ गते कर्तव्य ज्यान मुद्दामा सर्वोच्च अदालतले गरेको फैसलामा कस्तो घोषणालाई मृत्युकालीन घोषणा मान्ने भन्ने स्पष्ट गरिएको पाइन्छ। मुद्दा जीतबहादुर गिरी र नेपाल सरकारले कपिलवस्तु गोटिहवाका अब्दुल अजीज मुसलमान भन्ने अजीज मुसलमानसहित विरुद्ध दायर गरेका थिए।

उक्त फैसला तत्कालीन माननीय न्यायाधीशहरू प्रेम शर्मा र प्रकाश वस्तीको इजलासले गरेको थियो। मुद्दाको विषयवस्तु के थियो भने वि.सं. २०५४ भदौ १२ गते कपिलवस्तुमा फोहोरमैलाको निहुँमा भएको कुटपिटमा घाइते भएका कल्लु गिरीको उपचारका क्रममा मृत्यु भएको थियो।

उनलाई सफी अहमद मुसलमान, छेदीप्रसाद कुर्मी चौधरी, श्यामप्रसाद चौधरी, श्यामनाथ तिवारी लगायतका व्यक्तिहरूले लाठी, भाला, इँटाले समेत कुटेर घाइते बनाएको भन्दै जीतबहादुर, रामबहादुर र मीनबहादुर गिरीले जाहेरी दिएका थिए।

भदौ १३ गते उनीहरूले दिएको जाहेरीमा ज्यान मार्ने उद्योगमा मुद्दा चलाउन माग गरिएको थियो। उक्त मुद्दामा भदौ १४ गते त्यसबेलाका घाइते कल्लु गिरीले होस खुल्नासाथ लुम्बिनी अञ्चल अस्पताल बुटवलमा गरेको एउटा घोषणालाई प्रमाणका रूपमा पेश गरिएको थियो।उनले त्यस घोषणामा यस्तो लेखेका थिए।

१२ गते बिहान गाविस अध्यक्ष सन्तरी मुसलमान र वडा अध्यक्ष छेदी कुर्मीले यसलाई मारेर फ्याँकिदेऊ भनी आदेश दिएपछि अजीज मुसलमान, सई मुसलमान समेतले मलाई आ–आफ्नो हातमा लिई आएको लाठी, भालासमेतले मेरो शरीरमा प्रहार गरि म तत्काल सख्त घाइते भएँ। त्यसपछि म बेहोस भएछु। मलाई लुम्बिनी अञ्चल अस्पतालमा भर्ना गरेका रहेछन्। १४ गते २१ बजे मात्र मलाई होस् आएको हो।

त्यसलाई मृत्युकालीन घोषणा मान्ने वा नमान्ने भन्ने बहस चल्यो।

सर्वोच्चले आरोपितमध्ये केहीलाई सफाइ दियो र केही आरोपितका हक उक्त फैसलामा सर्वोच्चले मृत्युकालिन घोषणाबारे भनेका कुराहरू कुनै कागज मृत्युकालिन घोषणा हो वा होइन निर्क्योल गर्न घोषणाकर्तालाई आफू मृत्युको सन्निकट रहेको आभास भएकै हुनुपर्ने।

सिद्धान्ततः आफू पक्कै मर्ने अवस्थामा पुगेको आभाष घोषणाकर्तालाई भएको सम्बन्धित कागजबाट देखिएको छ भन्ने स्थापित भएपछि मात्र त्यसका अन्तर्वस्तुमा प्रवेश गर्न मिल्छ।

मृतकको कथन मृत्युकालिन घोषणा हुनका लागि घोषणाकर्ता कति समयभित्र मर्न पर्छ भन्ने सीमारेखा तोकिएको हुँदैन। तर, सो कथन र मृतकको मृत्युबीच मृत्युका अन्य कारण र अवस्था विद्यमान हुनु हुँदैन।

प्रमाण ऐनको कुनै दफाको सीमामा परेन भन्दैमा कुनै लिखित अभिव्यक्ति प्रमाणशून्य हुँदैन। प्रमाण ऐनका अन्य कुनै व्यवस्थाअन्तर्गत त्यो प्रमाण हुन सक्दछ भने त्यसको न्यायिक मूल्याङ्कन हुनसक्ने।

आफूउपर घटेको घटनाका सम्बन्धमा सविस्तार व्यक्त गरी गरिदिएको कागजलाई अन्य स्वतन्त्र प्रमाणबाट खण्डित नभएको अवस्थामा प्रमाणको रूपमा ग्राह्य हुनेछ।

अहिले दर्ता भइरहेका आत्महत्या दुरुत्साहनसम्बन्धी मुद्दाहरूमा पनि कस्तो कुरालाई मृत्युकालिन घोषणा मान्ने भनेर सर्वोच्चको उक्त नजिर हेरिने छ।

विगतमा यस्तै प्रकारका घटना निम्न रहेछन्।

–  पत्रिकामा आफ्नो आपत्तिजनक तस्बिर छापिएका कारण अभिनेत्री श्रीसा कार्कीले आत्महत्या गरेपछि कलाकारहरूले मुद्दा दर्ता गराउन खोजेका थिए। तर कानुन नभएकाले मिल्दैन भनियो।

–  कञ्चनपुरको महेन्द्रनगरमा एक विधार्थीले शिक्षकले पिटेको कुरा कारण खुलाएर सुसाइड नोट लेख्दै आत्महत्या गरे। मृतकका आफन्तको जाहेरीपछि शिक्षक पक्राउ परे।

–  राजधानीको समता अस्पतालमा काम गर्ने कर्मचारीले अस्पताल परिसरभित्रै सुसाइड नोट लेखेर आत्महत्या गरिन्।

–  सुसाइड नोटमा अस्पतालका अध्यक्ष उत्तम सन्जेलकी श्रीमतीलाई घुमाउरो पारामा आरोप लगाइएका कारण प्रहरीले उनलाई पक्राउ गर्‍यो।

–  अख्तियार दुरुपयोग अनुसन्धान आयोगले भष्ट्राचारको आरोप लगाएपछि मालपोतका निलम्बित कर्मचारी हरिप्रसाद आर्चायले सुसाइड नोट लेख्दै आत्महत्या गरे। सुसाइड नोटमा आचार्यले अख्तियारकै कारण आफू मरेको संकेत गर्दै अख्तियार प्रमुखलाई ‘दुई सय वर्ष बाँच्नु’ भनेर व्यंगात्मक रुपमा शुभकामना दिएका थियो।

निष्कर्ष:


विगतमा नेपालकै अदालतले प्रतिपादन गरेका सिद्धान्त तथा र भारत तथा अन्य मुलुकले प्रतिपादन गरेका सिद्धान्तको अध्ययन गरी रवि लामिछानेको केशमा हाम्रो अदालत निश्कर्षमा पुग्‍नुपर्दछ।

मर्न लागेको व्यक्तिले बोल्ने वा भन्ने अन्तिम शब्दहरुलाई ‘डाइङ डिक्लरेसन’ मृत्युकालिन घोषणाका रुपमा फौजदारी अपराधमा स्वीकार्य प्रमाण मान्‍ने गरिएको छ।

मृत्यु भइसकेको हुनाले त्यस्तो व्यक्ति अदालतमा उपस्थित हुन नसक्ने हुँदा ‘डाइङ डिक्लरेसन’लाई नै उसको बयान मान्ने गरिन्छ। सतहमा ‘भनेसुनेको प्रमाण’ (hear-say) जस्तो देखिए पनि ‘डाइङ डिक्लरेसन’को हैसियत त्यसभन्दा बलियो हुन्छ भन्‍ने फौजदारी कानुनको सिद्धान्तले भनेको देखिन्छ। तर यसरी ‘डाइङ डिक्लरेसन’ मृत्युकालीन घोषणा गर्दा त्यसो गर्नेलाई भनिएका कुराको वास्तविक ज्ञान हुनुपर्ने मान्यता राखिन्छ।

त्यसैले ‘डाइङ डिक्लरेसन’लाई स्वीकार्य प्रमाण मान्ने कि नमान्ने भन्ने विवाद पनि रहँदै आएको छ। ‘डाइङ डिक्लरेसन’लाई स्वीकार्य प्रमाण मान्न हुन्न भन्नेहरुको दाबी छ- ‘डाइङ डिक्लरेसन’ एकोहोरो हुन्छ। यसमा दोहोरो परीक्षण गर्ने मौका हुँदैन। यसमा जो कोही पनि फस्न सक्ने सम्भावना रहन्छ।

‘डाइङ डिक्लरेसन’ मृत्युकालीन घोषणालाई स्वीकार्नको लागि अरु प्रमाणले सपोर्ट गर्नु पर्दछ। भारत र नेपालको नजिर अध्ययन गर्ने हो भने मृत्युकालिन घोषणलाई प्रमाणका रुपमा लिन निम्न कुरालाई ध्यान दिनुपर्छ।

आत्महत्या गर्ने बेलामा कसैको नाम लेखेर वा बोलेर गयो भन्दैमा त्यो प्रणाम बन्छ भन्ने हुँदैन। कानुनी रूपमा प्रमाण हुने गरि त्यो कुरा स्थापित हुनुपर्छ, अदालतमा उक्त प्रमाणको परीक्षण हुने भएकाले मृतकले आरोप लगाएकै भरमा त्यो प्रमाण हुन नसक्ने।

अदालतमा मृतकलाई मृत्युको मुखमा पुर्‍याउने परिस्थिति सिर्जना भएको हो वा होइन जाँच हुन्छ। त्यो हेर्ने धेरै आधारहरु हुन्छ, त्यसैले कसैले मर्नुअघि कसैलाई पोल्दैमा त्यसलाई प्रमाण मानिन्छ भन्ने हुँदैन। मृतकले झुटो बोल्दैन भन्ने सिद्धान्त स्थापित गर्नका लागि परिस्थिति सिर्जना भएको देखिनुपर्ने हुन्छ।

कानुनले सबै सुसाइड नोटलाई प्रमाण मान्दैन तर प्रमाण हुनसक्ने सुसाइड नोट पनि हुन्छन्। कानुनी आधार भएका मृत्युकालीन घोषणालाई चाहीँ प्रमाण मानिन्छ।  आत्महत्या गर्ने स्तरसम्मको पृष्ठभूमि थियो कि थिएन, त्यो हामीले हेर्नैपर्छ।

नत्र भने आत्महत्या गर्नेले लेखेको सुसाइड नोट वा तिनका आफन्तले दिएको किटानी जाहेरीकै आधारमा मुद्दा चलाउन थाल्ने हो भने भोलिका दिनमा हरेक आत्महत्याका घटनामा आत्महत्या दुरुत्साहन कसुरमा मुद्धा चलाउनुपर्ने अवस्था आउन सक्छ। आत्महत्या स्वयं अपराधजस्तै भएकाले आत्महत्या दुरुत्साहन कसुरको कार्यान्वयन पक्षमा सरोकारवाल पक्ष गम्भीर हुनुपर्ने देखिन्छ। त्यसैले सुसाइड नोट र डाइङ डिक्लरेसनलाई एउटै मानेर व्यवहार हुनु हुँदैन।

अहिले रवि लामिछानेको मुद्दामा पनि उनलाई आरोपित गरिएको भिडिओ सुसाइड नोट मात्र हो।

उक्त भिडियाेलाई मृत्युकालिन घोषणा मान्ने वा नमान्नेबारे अनुसन्धानबाट प्रमाणित गर्नुपर्ने अहिलेसम्मको नेपालको कानुनी अभ्यास र नजिरहरू हेर्दा मृत्युकालिन घोषणा भनेको औपचारिक हुनुपर्ने, कसैले मृत्युका बेला जसको नाम लिन्छ त्यसले आफूलाई दु:ख दिएको वा अफ्ट्यारोमा पारेकोबारे पक्कै कसैसँग कुरा गरेको हुनुपर्छ, यदि त्यस्तो गरेको छैन भने त्यसलाई मृत्युकालिन घोषणा हो भनेर पुष्टि गर्न सहज हुँदैन।

नेपालमा आत्महत्या दुरुत्साहनको कानुनी अभ्यास नयाँ भएकाले धेरै मान्छेले मर्ने बेलामा लेखेको वा बोलेको सबै प्रमाण हुन्छ भन्ने बुझेको अदालतमा पुगिसकेपछि आत्महत्या गर्नेको मानसिक अवस्थाबारे पनि अनुसन्धान हुन्छ। कोही व्यक्ति मानसिक रोगी छ वा औषधी खाइरहेको छ भने उसले मृत्युअघि गरेको घोषणा ठिक हो भन्ने ठहर्‍याउन सहज हुँदैन।

महान्यायाधिवक्ता र अदालतको भूमिका


अनुसन्धानको नाममा जाहेरी दरखास्त परेकै भरमा विना प्रमाण पक्राउ गर्न अनुमति दिने र कथित अनुसन्धानको नाममा थुनामा राख्न अनुमती दिने अदालतको व्यवहार चिन्ताको बिषय रहेको छ।

नेपालमा फौजदारी अपराध संहिता आउनुपूर्व आत्महत्याको निम्ति दुरुत्साहन गर्ने व्यक्तिलाई सजायको कुनै व्यवस्था थिएन। तर, यस संहिताले आत्महत्याको निम्ति दुरुत्साहन गर्ने व्यक्तिलाई सजाय गर्ने व्‍यवस्था गरेकाे छ, जो ज्यादै नै सकारात्मक पक्ष पनि हो। कोही कसैको विरुद्ध कुनै जाहेरी पर्‍यो भने अनुसन्धानकर्ताले अनुसन्धान गर्नु उसकाे कर्तव्य हो।

अनुसन्धानको निम्ति अदालतको आदेशले जाहेरीमा आरोपित व्यक्तिलाई पक्राउ गर्ने अनुमति प्राप्त गर्नु र निजलाई पक्राउ गर्नु पनि उसकाे कर्तव्‍य अन्तर्गत पर्दछ। दुर्भाग्य, फौजदारी मुद्दामा आजकल हाम्रो अदालतको हैसियत प्रहरीको मुद्दा शाखाभन्दा भिन्न देखिने गरेको छैन। प्रहरीले पक्राउ गर्ने अनुमति माग्यो, दियो। थुनामा राख्‍ने अनुमति माग्यो, दियो।

निजको विरुद्ध जाहेरी भन्दा वाहेक वा जाहेरीलाई समर्थित गर्ने सामान्य प्रमाण छ वा छैन सो जाँच्नु वा हेर्नु आजकाल अदालतको कर्तव्य अन्तर्गत परेको जस्तो पटक्कै देखिँदैन।

अपवाद वाहेकका पक्राउ गर्न वा थुनामा राख्न अनुमति मागिएको व्यक्तिविरुद्ध जाहेरी वाहेक अन्य प्रमाणको अभावमा थुनामा नराखेर अनुसन्धान प्रकृया अगाडि बढाउनु भनी अनुसन्धानकर्तालाई आदेश दिनु भनेको हैसियत भन्दा बाहिरको विषय हो भन्ने जस्तो अदालतले ठान्‍नु गलत हो।

निश्चित हो, रवि लामिछाने चर्चित सामाजिकअभियन्ता हुन् र निजलाई राज्यले फसाउँछ कि भन्ने आम जनताको सरोकार रहेको छ। उनले अपराध गर्दैनन् भन्ने कदापि होइन। रवि लामिछानेले गरेको प्रचण्डको आलोचना र प्रचण्डकी छोरी भरतपुर नगरपालिका कि मेयर रेणु दाहालले रवि लामिछानेलाई गरेको आलोचना साथै चितवनमा प्रहरी प्रमुख प्रचण्डसँग लामो समय सुरक्षा गार्ड भएको कारणले रविलाई फसाउन सक्छन् भन्ने जनताको चिन्ता देखिन्छ।

1) Kushal Rao v. State of Bombay

a) First, a dying declaration which has been recorded by a competent Magistrate in the proper manner i.e. in the form of questions and answers, &, as far as practicable in the words of the maker of the declaration stands on a much higher footing than a dying declaration which depends upon oral testimony. The court observed that dying declaration that depends upon oral testimony may suffer from all the infirmities of human memory & human character.

b) Second, there is no absolute rule of law that a dying declaration cannot be the sole basis of conviction unless corroborated and therefore, a true & voluntary declaration can be sole basis of conviction, provided, it is corroborated.

c) Third, a dying declaration stands on the same footing as other piece of evidence. Therefore, it has to be judged in the light of surrounding circumstances and with reference to the principle governing the weight of evidence.

d) Fourth, a dying declaration is not a weaker kind of evidence than any other piece of evidence; however, each case must be determined on its own facts and the court must keep in view the circumstances in which the dying declaration was made.

e) Fifth, the court must test the reliability of the dying declaration for which it has to keep in view the circumstances like the opportunity of the dying man for observation. For instance, whether there was sufficient light if the crime was committed in the night. The court must also test whether the capacity of man to remember the facts stated had not been impaired at the time he was making the statement by circumstances beyond his control.

f) Sixth, the court must also test whether the statement has been consistent throughout if he had several opportunities of making a dying declaration apart from the official record of i. Also, the statement had been made at the earliest opportunity & was not the result of tutoring by interested party.

2) U.P. v. Madan Mohan

a) It is for the court to see that dying declaration inspires full confidence as the maker of the dying declaration is not available for cross-examination.

b) Court should satisfy that there was no possibility of tutoring or prompting.

c) Certificate of doctor should mention that victim was in a fit state of mind. Magistrate recording his own satisfaction about the fit mental condition of the declarant was not acceptable especially if the doctor was available.

d) Dying declaration should be recorded by the executive magistrate & police officer to record the dying declaration only if condition of the deceased was so precarious that no other alternative was left.

e) Dying declaration may be in the form of questions & answers & answers being written in the words of the person making the dying declaration. But court cannot be too technical.

3) Upendra Baxi le “Abetment to Suicide: What a Relief!”
( 17, 2018) The author is an international law scholar, an acclaimed teacher and a well-known writer. He was recently felicitated by India Legal legend .

In the popular mind, a mere mention of names in a suicide note is sufficient, if not clinching, evidence of abetment to this crime. But this is scarcely so in law; nor is a first information report (FIR) or even a charge-sheet always decisive; these can be quashed by courts.

The criminal justice system is based equally on presumption of innocence and jurisdiction of strong suspicion upon which investigation and prosecution rests. Justices have to find the right balance between guilt beyond reasonable doubt and self-victimage of a suicide, which is not always a victimless crime.

Three recent decisions of High Courts reinforce the position that a mere suicide note naming a person does not constitute sufficient evidence of the offence of abetment. Justice AH Joshi of the Bombay High Court delivered a stark message: “This is no mathematical equation, that a suicide note plus threat equals abetment…If harassment is proved, show the proof.” He further said: “A threat to kill is not abetment. …An advice to kill is also not abetment.”

It is noteworthy that this appeal, filed by the woman victim’s family, was dismissed by the Court for non-appearance of the lawyer.

The second decision is by the Madurai Bench of the Madras High Court which relied on the Rajamannar case (2014) that said: “If a lover commits suicide due to love failure, if a student commits suicide because of his poor performance in the examination, a client commits suicide because his case is dismissed, the lady, examiner, lawyer respectively cannot be held to have abetted the commission of suicide.

For the wrong decision taken by a coward, fool, idiot, a man of weak mentality, a man of frail mentality, another person cannot be blamed as having abetted his committing suicide.” But not all persons commit suicide because of such blameworthy reasons and a muscular app-roach is best avoided in apprising the evidence.

The Punjab and Haryana High Court was confronted by a situation where the victim, a manager (taxation) at a Gurgaon-based company, committed suicide on March 23, 2011 and claimed in his suicide note that four lawyers and two officers of his company had forced him to do the act. Justice PB Bajanthari held that a mere mention of a person’s name in the suicide note does not empower the Court to “jump to a conclusion that it is enough to mulct the accused with criminal liability under Section 306 IPC”.

Rather than jumping around, “one has to analyse and examine the contents of the suicide note to find out whether it contains any incriminating information in the nature of instigation, provocation, forcing the victim to committed suicide.” It quashed the FIR against these six people.

The Court made a compelling case for an “overall analysis” of “incidents” of suicide and found that no “cogent material” exists. It said: “The offence of abetment requires ‘mens rea’ (guilty mind). There must be intentional doing/aiding or goading the commission of suicide by another. Otherwise, even a mere casual remark, something said in routine and usual conversation will be wrongly construed or misunderstood as ‘abetment’.”

For abetment to have been successfully proved, the first condition is, of course, that the suicide must have actually happened. The Supreme Court clearly held this in Satvir Singh (2001) because it is possible to abet the commission of suicide but not a mere attempt to do so. The second condition is that the accused must be shown to have “instigated” the victim by conduct of comprising acts and omissions.

The apex court has urged caution and scrupulousness in appraising the evidence and insisted that instigation must entail a “live link” and “active role” in causing suicide. If the legislation has not defined “instigation”, neither have the courts. However, the courts have freely engaged terms like “urging”, “goading” or leaving “no other choice”.

At times, the Legislature makes this burden of proof explicit. For example, Section 113A of the Indian Evidence Act, 1872, now enjoins the courts to presume abetment in situations where a death occurs of any woman within seven years of her marriage and on hard evidence of cruelty by her husband or any of his relatives.

However, outside law reform that results in statutory directives, the burden of adjudicating abetment falls on courts. And of necessity, they take account of contexts. Some doctrinal inconsistency results, but nevertheless, the principles of liberty and fairness in the administration of criminal justice remain works in progress.

For example, courts have held that no instigation can be said to exist in situations where there is a time gap between when the deceased was last harassed and her death; the death occurred within a few months of marriage and in the absence of any complaints by the deceased to her parents regarding any maltreatment, torture, bringing insufficient dowry; no implication of the husband in a dying declaration; instances of quarrel due to consumption of liquor; dissatisfaction and unhappiness owing economic disparity between natal and matrimonial family and failure of the accused to appear on the settled date of marriage with the deceased with whom he had a love affair.

Even in situations of bigamy where subsequent separate living resulted, without means of support, the court found lacking any intention to abet suicide or knowledge that commission of suicide was a likely consequence.

A pattern seems to emerge out of the case law. One feature is that district courts more often convict, whereas appellate courts usually reverse.Second, more attention in abetment cases is paid to comparative persuasive precedents from other High Courts than is usual.

Third, a large number of cases of abetment involve suicides by women.One can in some these situations suggest a more solicitous regard arising out of feminist jurisprudence and the fundamental duty of citizens in Article 51(a)(e) of the Constitution to “abjure practices derogatory of dignity of women”.In the administration of criminal justice, this duty should not be relegated to the backseat or the boot of the judicial caravan.

3) LORD LUSH, L.J.,“A dying declaration is admitted in evidence because it is presumed that no person who is immediately going into the presence of his Maker, will do so with a lie on his lips. But the person making the declaration must entertain settled hopeless expectation of immediate death. If he thinks he will die tomorrow it will not do.”

4) LORD EYRE, C.B.,“The principle on which this species of evidence is admitted is, that they are declarations made in extremity, when the part is at the point of oath, & when every hope of this world is gone; when every motive of falsehood is silenced, & the mind is induced by the most powerful consideration to speak the truth; a situation so solemn & awful is considered by law as creating an obligation equal to that which is imposed by a positive oath administered in the court of justice.”
